Terms for patients using patient-facing functions within the SmartEating clinical service. Provided by Smart Lifestyle AS, organisation number 829 972 972. Audience: patients and, where applicable, guardians.
1.Scope and who provides what
These Patient Terms govern a patient’s use of the patient-facing functions of the SmartEating clinical service, including any companion or self-service surface enabled for the patient. The software service is provided by Smart Lifestyle AS, organisation number 829 972 972, c/o Christoffer Riseng Bølla, Strandvegen 107, 2315 Hamar, Norway (Smart Lifestyle, we, us or our). Contact: support@smarteating.ai or +47 45 84 94 84.
The clinic or healthcare professional connected to the patient’s account provides the healthcare service. Smart Lifestyle supplies the software and does not become the patient’s treating healthcare provider. The clinic’s treatment terms, patient information and privacy notice continue to apply.
2.Account and eligibility
A patient may use the Service when access has been lawfully enabled by the clinic or Smart Lifestyle for the relevant service. Account information must be accurate. Authentication factors and devices must be kept secure, and suspected unauthorised access must be reported promptly.
The patient-facing Service is generally intended for adults. Use by or for a person under 18 requires the clinic to confirm that the use, information and any guardian involvement are lawful and appropriate. A child patient may still have a clinical record even when the child does not personally use the Service.
3.What the patient Service does
Depending on what the clinic enables, a patient may view or contribute information, follow a clinician-approved plan, log meals and progress, use recipes or shopping functions, submit check-ins, and connect optional health or wearable data. Features may differ between clinics and may change during a pilot or preview.
Information shown in the patient surface may include content prepared by the clinic, information entered by the patient, calculations and generated drafts. The clinic decides what constitutes clinical guidance and what belongs in the patient record.
4.Healthcare, safety and emergencies
Not an emergency service. Do not use SmartEating to request emergency help. If urgent medical help may be needed, contact the appropriate emergency or healthcare service immediately and do not wait for a response in SmartEating.
SmartEating does not replace the patient’s clinician. A patient should follow the clinician’s instructions and ask the clinic about symptoms, medication, allergies, treatment, significant dietary changes or information that appears incorrect. The Service must not be relied on for diagnosis, triage or autonomous treatment.
5.Patient information and responsibilities
The patient should provide information that is accurate to the best of their knowledge and update material changes when the clinic asks. Information about another person must not be submitted without a lawful reason and appropriate authority.
- Review entries and notify the clinic if important information is missing or incorrect.
- Do not use another person’s account or allow another person to use yours.
- Use messaging and logging functions respectfully and only for their intended health or nutrition purpose.
- Do not upload unnecessary identifiers, credentials, secrets, unlawful content or malicious files.
6.Generated information
Some functions use machine learning to recognise foods, transcribe speech, organise information or prepare drafts. Generated information can be wrong, incomplete or unsuitable. It is not a diagnosis or independent treatment recommendation. Where clinical review is required, the material remains a draft until the clinic approves it.
A patient should not make a significant health or treatment decision based only on generated material. Questions should be directed to the treating clinic. Smart Lifestyle does not use patient content to train a general-purpose model for its own purposes.
7.Photos, voice and optional health connections
A patient may choose to submit a meal photo or other supported image, use a voice function, or connect a supported health or wearable service. The permission screen identifies what is requested. Only enable a connection if you understand and accept the permissions. You can revoke a device or provider permission through the relevant settings.
Revoking or disconnecting stops future collection through that connection. Information already imported into the SmartEating patient record is handled under the clinic’s legal and record-retention duties and is not necessarily deleted automatically when the external connection is removed.
8.Privacy and patient records
The clinic is normally responsible for deciding why patient and clinical data is used and how the patient record is handled. Smart Lifestyle processes that information for the clinic to provide the Service. The Patient Privacy Notice explains these roles, data categories, recipients and patient rights in more detail.
Deleting an account or disconnecting a feature does not automatically erase a patient record. Healthcare and record-keeping law may require the clinic to retain, correct, restrict, disclose or transfer information. Requests about a patient record should be directed to the clinic.
9.Availability and changes
The Service may be interrupted for maintenance, security, provider failures or capacity reasons. It is not guaranteed to be continuously available. Important health information and emergency communication must use the clinic’s approved alternatives when SmartEating is unavailable.
Features and these Terms may be updated for legal, safety, security or service reasons. Material changes will be communicated through the Service, by email or through the clinic when appropriate before they take effect.
10.Ending or restricting access
The patient, clinic or Smart Lifestyle may end or restrict access as permitted by the applicable relationship. Access may be suspended where reasonably necessary to protect the patient, other Users or the Service; respond to a security or legal requirement; or prevent misuse.
When access ends, the clinic remains responsible for continuity of healthcare and the patient record. Smart Lifestyle handles stored information under the clinic’s instructions, the applicable data processing agreement and mandatory law.
11.Responsibility and liability
Smart Lifestyle will provide the software service with reasonable care but does not promise that every generated result or external data item is correct or that the Service will be uninterrupted. The clinic remains responsible for healthcare and professional decisions. Nothing in these Terms limits rights or remedies that cannot lawfully be limited, including rights under consumer or data-protection law where they apply.
12.Law and contact
Norwegian law governs these Terms, subject to mandatory patient or consumer protections that apply. Questions about treatment or the patient record should be directed to the clinic. Questions about the SmartEating software or account may be sent to support@smarteating.ai or Smart Lifestyle AS, c/o Christoffer Riseng Bølla, Strandvegen 107, 2315 Hamar, Norway.
